Cosatu and Sasbo have failed to comply with the provisions of the LRA but they remain defiant.

The  Court ruled that the planned banking sector strike would be unprotected after Business Unity South Africa (BUSA) launched an urgent court application to interdict the strike.

At least 50 000 people were expected to join a banking sector national strike led by the finance union Sasbo.

Busa was seeking to stop the strike as it argued that Cosatu’s section 77 notice sent to the National Economic Development and Labour Council (Nedlac) may not satisfied the requirements for the strike to be legally protected.

However Cosatu deputy general-secretary Solly Phetoe said that the federation was advised by its legal team to appeal the ruling and and plans for another bank strike have been resubmitted.
