The Constitutional Court has agreed with the North Gauteng High Court that the Public Protector, Busisiwe Mkhwebane's entire ABSA/Bankorp investigation was flawed and that She was not honest during her investigation. The apex court dismissed the South African Reserve Bank's application for a declaratory order to find the Public Protector abused her office while she undertook the investigation.

The Public Protector's application for leave to appeal the judgement in the High Court and the Supreme Court of appeal were refused.

However the Public Protector said she has noted the judgement against her by the Constitutional Court, which will require her to personally pay 15% of the fees incurred by the South African Reserve Bank/Bankorp matter, She was speaking after the Concourt upheld the personal costs order against her.

She further disagreed with the majority ruling that she was dishonest under oath.
