The Senzo Meyiwa murder trial has been postponed to Monday to allow the defence counsel to study documents containing evidence from a cellphone analyst.
Police constable Sizwe Skhumbuzo Zungu came under scrutiny this week for allegedly withholding information for “four or five years” which could have helped solve Meyiwa’s murder much earlier.
His evidence has placed all the accused in the trial at a hostel in Vosloorus on the day Meyiwa was shot and killed at his then-girlfriend Kelly Khumalo’s family home on 26 October 2014.
The police officer had spent the day with his nephew, Gwabini Zungu, who lived at the hostel, when he was introduced to the suspects.
Zungu testified during his cross-examination on Tuesday he saw two of the five men accused of killing Meyiwa carrying guns on the day, but he didn’t make any arrests nor did he report the information to the police.
Advocate Zandile Mshololo, who represents Fisokuhle Ntuli, told the court her client was not in Vosloorus, but in Johannesburg, on the afternoon of Meyiwa’s death.
Mshololo suggested that her client was nowhere near the Sotho Hostel on 26 October 2014.
“You see that the place is at George Goch Hostel. It’s not the hostel where you said the accused were,” she asked to witness Constable Skhumbuzo Zungu, during cross-examination.
“In other words, the version that the picture was taken was around 17:00 when they were not in Sotho Hostel as you said, but they were in George Goch Hostel”.
Zungu refused to comment, saying he did not follow the accused around on the day.
“I am only seeing the suspects in the picture. I don’t know where they were. I was not following them around. “
State prosecutor, Advocate George Baloyi, objected to Mshololo’s statement that the images were captured in Johannesburg.
“As it pleases the court, my lord if counsel could say where in the picture it says that it was taken from George Goch, unless that was the instruction presented from the accused.”
“That’s the buildings. I don’t think that’s the proper objection because we are just putting our own version,” said Mshololo.
The trial has been postponed until Monday.
Mshololo said this will allow her time to determine when and where the picture was taken.
“I would like the witness to be called because I need to get my own device to open these pictures wherein the date of the pictures were taken. It is reflected in my memory stick,” she said.
Judge Ratha Mokgoatlheng adjourned the trial and will resume on Monday to conclude Zungu’s cross-examination.
