The State in the murder trial of former Bafana Bafana and Orlando Pirates captain Senzo Meyiwa insists there is enough evidence linking accused 4 Mthokosizeni Maphisa to the murder.
The state argued that Maphisa played a role in the killing of the soccer star. It also adds that the two confessions by accused number two, Bongani Ntanzi, are sufficient, which places all five men at the scene.
Charles Mnisi, representing accused one, Muzikawukhulelwa Sibiya, and accused three, Mthobisi Mncube, as well as Sipho Ramosepele, representing accused two, Ntanzi, abandoned their bids for discharge of charges.
The state prosecutor George Baloyi told the court before the proceedings started, that the vehicle transporting Maphisa from Leeuwkop Correctional Centre in Sandton had been involved in a minor collision.
Baloyi explained that Maphisa, though unharmed, could be taken for a routine medical check-up.
But Maphisa told the court he was fine and wished to proceed.
“It was not a serious accident because only the front part of the police van was damaged, but he says he is fine,” Nxumalo said.
Judge Ratha Mokgoatlheng addressed Maphisa’s counsel, advocate Zithulele Nxumalo, to confirm if his client was ready to proceed.
“The law is very funny because you can waive it. He is the only one who can waive that right. I am not saying he must waive it,” Mokgoatlheng said.
Maphisa reiterated that he was fine and wished to continue with the proceedings. Mokgoatlheng then cautioned Maphisa about potential future complications.
“If you later discovered issues, such as a latent fracture, it doesn’t mean you cannot sue the government in 20 years’ time based on your decision to continue.
The trial proceeded as Maphisa opted to waive his right to an immediate medical examination.
Meyiwa was shot at the home of his girlfriend, singer Kelly Khumalo, in what the State believes was a hit.
Maphisa, Mncube, Sibiya, Ntanzi and Sifisokuhle Nkani Ntuli are on trial for Meyiwa’s murder. The state alleges they acted in furtherance of a common purpose. They have all pleaded not guilty.
