The African National Congress (ANC) accuses its MP Boy Mamabolo for failing to submit a matric certificate, nor the legal qualifications listed on his CV.
Mamabolo approached the courts after being left off the ANC’s candidates list ahead of the elections this year.
City Press reports that the ANC is telling him to prove he has the qualifications he needs to be on the list.
Mamabolo approached the courts demanding that the ANC and its national list committee produce several documents.
The documents include reports compiled by the independent agency hired to vet candidates, the total number of candidates on the list who were retained based on experience as current MPs and MPLs, the vetting and screening report, and the total number of candidates on the list who were retained based on experience such as current members of Parliament and legislatures.
Mamabolo also wants the full nominations list from the various branches and the book of forms of the branches as uploaded onto the cloud, as well as an explanation or reasons for his removal and/or exclusion from the final list.
He wants the high court to grant him access to a copy of his interview score card and/or minutes of his interviews, copies of his vetting and screening report and the minutes of extended provincial executive committee (PEC) meetings for the provincial list confirming the adoption of the list.
Other demands include a copy of the approved final list approved by the PEC with additions and removals as envisaged, confirmation of the total branch nominations that he received and a copy of the list of the 20% that was added by the PEC officials and the total number of the added candidates that were part of the final list.
A source in the ANC told the publication that the party is aggrieved that Mamabolo took the legal route before exhausting internal party processes.
“There was a window period for aggrieved members to appeal their case within the party, which he did not do, till two weeks ago when the list was submitted. He then decided to go to court, which is against the party rules,” the source said.
The ANC’s court papers state that the MP never submitted documents to prove he has a matric certificate. He also never provided proof that he holds a law diploma from the University of Johannesburg (UJ).
Mamabolo’s CV claims he has these qualifications.
In his replying affidavit, the ANC provincial list committee chairperson in Limpopo, Kgoshi Thobejane, questioned how Mamabolo could claim to be a legal adviser if the MP had only listed five courses that he completed – criminal law and Law of Procedure Act, communication and business law, civil law, family law and labour law.
“No one can have a post-matric qualification without first passing matric. By the time I signed this answering affidavit, the applicant had not yet submitted his matric certificate,”added Thobejane.
Mamabolo said the accusations he didn’t have the necessary qualifications are “rubbish”.
Meanwhile Mamabolo has filed an R2-million defamation lawsuit against Isabella Kgaogelo Kganyago, his sister-in-law.
This is in response to reports that Kganyago made a “derogatory” voice note about Mamabolo, which was circulated on public platforms.
According to Mamabolo, his mother, through Ramusi Attorneys, demands an apology in video format. The MP and his foundation need no apology, as they consider the damage irreparable.
