The allegations involving Economic Freedom Fighters (EFF) leader Julius Malema have emerged in court papers filed by the Madlanga Commission of Inquiry in response to an urgent application brought by Crime Intelligence Deputy Head Major General Feroz Khan.
Fullview understands the commission learnt that Khan had secretly approached the court with an attempt to hold the proceedings in camera.
According to the affidavit by Tshepo Nyatlo, an investigator for the commission, Khan enlisted Malema’s help and, through an intermediary, supplied questions for the EFF to ask in Parliament.
In return, Khan provided Malema with confidential information.
The affidavit showed that in June 2021, Khan wanted Malema to help him remove the Inspector General of Intelligence, Isaac Dintwe.
Khan sent Malema questions that the EFF could pose in Parliament to Dintwe. The questions were intended to catch Dintwe in a lie.
Whatapp Messages also detail a plot between Khan and Malema to orchestrate the removal of Dintwe.
In the same month, Malema requested information about a police complaint that was opened against him in the VBS Mutual Bank saga.
Nyatlo, in his report, stated that Khan supplied Malema with the name and address of the complainant in the VBS matter, Anoosh Rooplal, the curator and also that the cop leaked confidential information on numerous instances to Mohamed Sayed, who is associated with the following companies, Carnilinx, Onyx Aviation, Cyberia, Smada and Branded World.
Onyx Aviation, a company with which Sayed appears to be associated, was responsible for flying former Ekurhuleni City Manager Imogen Mashazi to London for a weekend trip in July 2022 that was paid for by Ze Nxumalo. Sayed shared passenger manifests of this trip with Khan, Nyatlo reported.
Khan also supplied Sayed with internal SAPS reports, personnel identities, and details of SAPS jet movements and officers attending high-level meetings.
He is accused of conspiring with the businessman to use SAPS resources to neutralise Carnilinx competitors, Gold Leaf Tobacco and Protobac. Khan had been aware that Carnilinx was not tax compliant.
Drawn into this dragnet was Lieutenant General Molefe Fani, divisional commissioner for supply chain management, who was suspended after the Special Investigating Unit (SIU) linked him to an irregular contract during his tenure at National Treasury. The tender was for branded masks and Covid-19 test kits.
The affidavit also details a relationship between Khan, Sayed and the late Wiandre Pretorius, who frequently posed as SAPS member and who survived an assassination attempt outside his Boksburg home only to take his own life at a Brakpan filling station.
Pretorius was implicated in the 2022 murder and cover-up of Emmanuel Mbense. Khan brokered Pretorius’s employment with Sayed, and three coordinated “busts” against rival cigarette smugglers.
Matipandile Sotheni, a former highly trained SAPS member who resigned in 2019 and was recruited to work security for Sayed, is currently behind bars facing charges of murdering Madlanga Witness D, Marius van der Merwe.
The EFF leader has repeatedly described Khan as a longtime acquaintance from their ANC days and denied any wrongdoing in their relationship.
Khan is scheduled to appear before the Madlanga Commission on 1 July 2026, where he is expected to respond to the issues raised in the summons.
