Disgruntled ANC NW members drag newly-elected leadership to court.

The aggrieved members of the ANC North West has served the newly elected leadership of the party in the province with court papers.

The group is challenging the legitimacy of the elected top five leaders and provincial executive committee (PEC) members that were elected at the 9th North West ANC conference last weekend

In the court papers, they said there were irregularities and non-compliance with the ANC’s constitution.

The application be heard as an urgent application that it be declared that the notice calling for ANC’s 9th provincial conference of the North West from the 12 to 14 August 2022 is unlawful, invalid and of no force and effect. That is be declared that the ANC’s decision to usurp the powers and functions of the conference after the court had declared on 12 August understand case number: UM 152/2022 that the ten of IPC of the North West had lapsed is in violation of the ANC constitution and is unlawful and be set aside, “said the court papers.

The court papers also said the ANC was interdicted from continuing or finalising the conference’s continuation scheduled for the 26 to 28 August 2022.

“The ANC be ordered to appoint an interim structure in terms of the ANC constitution in the stead of the NW provincial executive committee pending the election of a lawfully constituted PEC of the ANC in the province.

“The first respondent (ANC) be ordered to pay the costs of the application on an attorney and own client scale, including the costs occasioned by the employment of two counsel.

“The second respondent (Nono Maloyi) to sixth respondents be ordered to pay the costs of the application only in the event of opposition jointly and severally with the first respondent, the one paying the other to be absolved on an attorney and own client scale including the costs accessioned by the employment of two counsel,” said the papers.

The 9th provincial ANC conference, which was tarnished by several delays due to legal action by dissatisfied ANC members, elected former ANC MP Maloyi as the provincial chairperson.

Maloyi beat North West Premier Bushy Maape for the top post after a clean sweep by his faction.

The other leaders elected to the top five leadership included Lazzy Mokgosi, Louis Diremelo, Viola Motsumi and Sello Monotho Lehari as deputy chairperson, provincial secretary, deputy provincial secretary and provincial treasurer, respectively.
