EThekwini legal says the structures act is clear that exco together with office bearers must be elected at the first meeting at council. He says before office bearers are elected saying they are elected from Exco.
He says the issue of exco has to be concluded and in the exco. He says before a mayor can be elected there has to be an exco with 10 members with all political parties that qualify.
He says if there is a resignation as Cllr Madlala indicated, it means the exco would be 9 and one councillor is eligible for exco who did not participate. He says if there is a vacancy that has to be rectified before office bearers are elected.
