Disgraced Dr Nandipha Magudumana’s court case challenging her arrest in Tanzania and deportation to South Africa has been postponed to next month.
The Free State High Court in Bloemfontein postponed on Friday morning to allow respondents to file replying affidavits.
Home Affairs Minister Aaron Motsoaledi has officially joined as the 6th respondent in the matter.
Motsoaledi has expressed his intention to challenge the urgency of the matter.
Magudumana was arrested in Arusha, alongside prison escapee Thabo Bester, in April where authorities suspect the couple were heading for the border between Tanzania and Kenya.
However, her legal team is arguing that her arrest was unlawful and without merit.
Magudumana and six others are facing charges relating to Bester’s daring escape from the Mangaung Correctional Centre in May last year.
Judge Philip Jacobus Loubser granted lawyers for the South African Police Services (SAPS) and the National Prosecuting Authority (NPA) until the end of business on Friday, 26 May 2023, to file their answering papers.
Home Affairs has until Monday to file the opposing papers.
The National Prosecuting Authority (NPA) has already indicated its intention to oppose Magudumana’s application.
