Alleged parliament fire suspect Zandile Mafe is applying for bail on Saturday in Cape Town.

The 59-year-old’s legal counsel, Dali Mpofu, arrived at 10am at the regional court amid a strong police presence and a small group of Mafe supporters singing outside.

Mafe has been in custody since January 2 when a fire broke out at the parliament buildings, leaving the National Assembly gutted.

His bail application was postponed last week after he contracted Covid-19.

He faces a raft of charges including arson, theft and terrorism.

Magistrate Michelle Adams granted permission for the media to report on and film court proceedings, with some conditions.

“Recording must stop when Mafe’s lawyers consult him in the court,” said Adams.

As soon as permission to film was granted, cameras surrounded the accused, clicking repeatedly while court officials tried to keep Covid-19 protocols in place.

Last week, the Western Cape High Court overturned an earlier decision for Mafe to be sent to the Valkenberg Psychiatric Hospital for mental evaluation.

Judge President John Hlophe further stated that Mafe be released from the facility.

He added that further detention of Mafe is unlawful and should come to an end with immediate effect. Judge President John Hlophe said further detention of Mafe was unlawful.

He ordered that Mafe be moved to a holding cell pending his upcoming bail application and the State plans to oppose Mafe’s bail application.
