South African Police Services (SAPS) Head of crime counter-intelligence Maj-Gen Feroz Khan and Gauteng head of Hawks Maj-Gen Ebrahim Kadwa have been granted bail under strict conditions.
The pair appeared alongside businessman Tariq Downes in the Kempton Park Magistrate’s Court on Monday, facing two charges including, the contravention of the Precious Metals Act and defeating the ends of justice.
They were arrested following investigations into allegations of illicit precious metals transactions, corruption and related offences.
They were each granted R20,000 bail under the conditions that they not interfere with the investigations, or, contact witnesses. They are also required to hand in their passports to the investigative officer on or before 12 May.
The trio are also required to alert the investigating officer within 72 hours if they intend to travel.
They were charged with contravening Section 4 of the Precious Metals Act 37 of 2005 and defeating the ends of justice.
The State did not oppose their release on bail. Rather, the prosecution reached an agreement with their lawyers.
The case has been postponed to 14 July 2026 for further investigations.
Speaking outside court, Athlenda Mathe, SAPS spokesperson said it was disappointing to have senior officers in court.
“But it shows that as an organisation we are committed to integrity, transparency and rooting out wrongdoing and corruption within our ranks. We always maintain that no one is above the law.”
National Prosecuting Authority (NPA) spokesperson Kaizer Kganyago said the NPA remains committed to ensuring accountability and upholding the rule of law, regardless of the status or seniority of those implicated in criminal conduct.
